1. Scope and Contracting Party

These Terms of Service ("Terms") govern your access to and use of the mobile game "TransferKings" (the "Game"), operated by Valorbyte UG (haftungsbeschränkt), Haid und Neu-Str. 18, 76131 Karlsruhe, Germany ("Provider", "we", or "us").

By downloading, installing, or using the Game, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Game.

2. Subject Matter

The Provider makes the game TransferKings available to users. The Game is available for:

The Game is free to download and play, but certain features, virtual goods, or benefits can be purchased for a fee (In-App Purchases).

3. License

The Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Game for your personal, non-commercial use.

You are not allowed to::

• Copy, modify, or create derivative works based on the Game
• Distribute, lease, lend, rent, or otherwise transfer the Game to any third party
• Reverse engineer, decompile, or disassemble the Game
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software
• Use the Game for any commercial purpose

4. Registration and User Account

To access certain features of the Game, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided during registration is inaccurate, false, or misleading.

5. In-App Purchases

5.1 General

The Game may allow you to purchase virtual items, currency, or other digital content (collectively, "Virtual Items"). All purchases are final and non-refundable, except as required by law.

• Are only available within the Game
• Are subject to forfeiture if your account is terminated or suspended

5.4 Withdrawal Right

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

For refunds, please contact the respective app store (Apple App Store or Google Play Store).

6. Rewarded Ads

6.1 Functionality

You may choose to watch advertisements in exchange for virtual rewards within the Game. This is entirely optional and not required to play the Game.

6.2 No Guarantee

We do not guarantee::

• The availability of Rewarded Ads
• The number of available advertisements
• The type or amount of rewards
• The content of third-party advertisements

We reserve the right to modify or discontinue the Rewarded Ads feature at any time.

6.3 Advertising Content

We are not responsible for the content of third-party advertisements. Any interactions with advertisers are solely between you and the advertiser.

6.4 Abuse

Any attempt to exploit or manipulate the Rewarded Ads system is strictly prohibited and may result in the suspension or termination of your account.

We reserve the right to remove any fraudulently obtained rewards.

7. Availability and Changes

We strive to ensure that the Game is available 24/7, but we cannot guarantee uninterrupted or error-free operation.

The Provider reserves the right to::

• Modify, update, or discontinue the Game at any time
• Change, add, or remove features or content
• Impose limits on certain features or restrict access to parts or all of the Game
• Require you to install updates to continue using the Game

8. User Obligations

You agree to use the Game in compliance with these Terms and all applicable laws and regulations.

• Do not use the Game for any illegal or unauthorized purpose
• Do not interfere with or disrupt the Game or servers
• Do not attempt to gain unauthorized access to the Game or related systems
• Do not harass, abuse, or harm other users
• Do not post or share any content that is offensive, defamatory, or infringing on intellectual property rights

9. Suspension and Termination

We may suspend or terminate your access to the Game at any time, with or without cause, with or without notice.

We may suspend or terminate your account if::

• You violate these Terms
• You engage in fraudulent or illegal activities
• Required by law or to protect our rights or the rights of others
• For any other reason at our sole discretion

Upon termination, your right to use the Game will immediately cease, and you must delete all copies of the Game in your possession.

You may stop using the Game at any time by uninstalling it from your device.

10. Liability

We are fully liable for damages resulting from injury to life, body, or health, as well as for damages based on intentional or grossly negligent breach of duty by us, our legal representatives, or our vicarious agents.

For other damages, we are only liable in case of breach of essential contractual obligations (cardinal obligations). In this case, our liability is limited to the typically foreseeable damage at the time of conclusion of the contract.

Our liability for data loss is limited to the typical recovery effort that would have been necessary if proper and regular backup copies had been made.

The above limitations of liability also apply to the personal liability of our employees, representatives, and organs.

11. Intellectual Property

All intellectual property rights in the Game, including but not limited to copyrights, trademarks, and trade secrets, are owned by or licensed to us. These Terms do not grant you any rights to use our intellectual property except as expressly set forth herein.

12. Privacy

Our Privacy Policy explains how we collect, use, and share your personal information. By using the Game, you agree to the collection and use of your information in accordance with our Privacy Policy.

13. Changes to the Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website or through the Game. Your continued use of the Game after such changes constitutes your acceptance of the new Terms.

14. Final Provisions

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms shall be Karlsruhe, Germany, provided that you are a merchant, a legal entity under public law, or a special fund under public law.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
